Andy, if your curious on the distinction from a legal perspective here in Massachusetts here is some light reading for you. The gist of it is that a brewpub license is different from what is called a "farmers pouring license". A brewery that just wants to serve their beer in their own taproom direct from their tanks and not establish a restaurant need only apply for a "farmers pouring license". Why are they called "farmers" pouring licenses? Well that's another long story that has led to a small brewery explosion here in Mass. but in a nutshell the state created a "farmers brewing license" that has a gigantic loophole in it and has allowed the opening of probably close to 100 small breweries and now that the door has been opened and these places being very popular they cannot easily close the loophole and hopefully they never will: http://www.connelllawoffices.com/tap-room-issues-for-breweries/ |
