They would still require a Federal brewing license which involves all sorts of things to make sure the taxman gets his cut. Also local zoning gets involved, which is why many of the ones is Los Angeles are in "industrial park" settings -- or old warehouse, etc. Many cities and counties have fairly onerous restrictions for a full alcohol license so a taproom can be way easier.
