One-Room Kneipen = Cafe Abseits?

This is EXACTLY the problem with what they want to do--what is a "Kneipe", and what is a "Gaststätte"? One of the articles Treinjan refers to mentions one aspect of the problem with Gaststätten with seperate smoking rooms: It's unfair to large Gaststätten withOUT seperate rooms to allow smoking, based on the July federal constitutional court ruling. Our two favorite Italian places are a perfect example: One has a seperate dining room, the other doesn't. I pessimistically fear that we'll end up back to where we were a year ago.
