German smoke ban to be partially overturned

Indeed the Bavarian law is being praised as an example of how the other states should have modeled their laws, since it does not allow for exemptions in multi-room places, thereby "discriminating against" small corner Kneipen. Today's paper went on about how it's a big relief for the pair of "Weißwürstchen" who have been hobbling about at the head of the CSU since Herr Doktor Ministerpräsident Stoiber retired (or was famously forced into retirement by a brash 50 YO hottie representative-ess from Fürth), that they will not now have to do any repair work with the Bavarian Rauchverbot. AFA the ruling goes: Meh. The other states should have done what Bayern did. And it's important to note that the judges themselves noted that a complete, total Rauchverbot across all kinds of establishments --regardless of size and clientele-- would NOT run into trouble against the constitution. The Bavarian court is supposed to rule on challenges to the "smoking club" loophole sometime too. I did see a notice once on Schlenkerla's website (?) or in their menü (?) about how that one small room by the toilets might possibly be able to be rented out to "closed societies" as a smoking room.
