I usually check the little displays that show where a seat is reserved. If there is a comparable seat that is not reserved for my part of the trip, I'll just take it. If not, I'll ask them to move. And if I've reserved a table or compartment or are traveling in a group, then I will ask them to move anyway. I have no idea if this is "correct" -- its just what I do :)
