Unless the train car is extremely empty, I always ask them to move. Sometimes if someone is in my window seat (for example), but the aisle seat is empty, I will sit there, and let them stay, but if later someone else asks me to move, then I ask the person in my seat to move. I have never had anyone refuse to move from my seat.
