It's even stated on some of Weyermann's labels, like the licorice porter: "Alkoholhaltiges Malzgetränk." Yep, a malt beverage that contains alcohol, but not a "beer." And there are some beer-ish things that are labelled "malt beverage" in the USA, yes; some of them are things like "Mike's Hard Lemonade" alcopops, which are scarcely recognizable as beer anyway.
