In Germany (national) we have a "Preisangabenverordnung" (regulation about how to specify prices).

Paragraph 7 says for "Gaststätten und Beherbergungsbetriebe" (restaurants, pubs and all enterprises where You can rent a room/bed, p.e. Hotels but also Pensionen, Ferienwohnungen etc:)
"Die in den Preisverzeichnissen aufgeführten Preise müssen das Bedienungsgeld und sonstige Zuschläge halten" (the prices in the menus must contain the money for the service and other supplements).

In contrast to the USA the wages per hour for the waiters are higher (the legal minimum wage is 8,50 Euro and 8,84 Euro for the years 2017 and 2018)..

Some wage contracts in Germany between the pub/restaurant and their waiters say, that the waiter get a share of the sales (often around 10% of the sales). That means that if the resulting sum is higher than the wage per hour, the waiter can be lucky. If the share is smaller than the wage per hour, the pub owner has to pay the difference.

A special case are the wages at the Oktoberfest and smiliar events. There the waiter buy the drinks and food and sell it to the guests. The waiter pay only around 90% or fewer of the menu price. The difference to the normal pubs is that the waiters at the Oktoberfest have to take the risk to get his money from the guest and the cullets. A Oktoberfest waiter earns maybe between 1,10 and 1,70 Euro per Maß depending in which tent he works.
