Normally the seller has to require a deposit (1,50 for the case, 0,08 for a bottle, 0,15 for a flip-flop-bottle).

The most breweries do so. Some breweries don't ask for a deposit, p.e. Witzgall and Zehendner. They have never asked for the deposit before and hesitate to start. Two reasons:
- They fear a negative reaction of their regular customers (both examples are breweries without the distribution channel supermarkets and shops).
- And if they would start with a deposit, they have to buy new, different cases and bottles to prevent that they give a deposit back that they have not obtain. The brewery Grasser in Huppendorf uses therefore two different cases (different colours). One without deposit for pubs and regular customery who buy the cases in the brewery, the other with deposit for shops and other resellers.

The rights situation: If the bottles are unity bottles (as the Witzgall bottles are), the custormer who have bought the bottles are the owner. They can do with the bottles what  they want. p.e. give them back in another store. The case rests in the ownership of the brewery, because the case is individual (with a logo or name of the brewery). You have to give the case back and don't get a deposit because you have not paid a deposit for the case.

In the view of Witzgall You are not friendly. You have get the bottles without a deposit and the brewery has to buy new bottles. And the price of the Witzgall beer is low so they have not calculated such losses. But You have done nothing illegal.

On the other hand Witzgall is stupid. If they abuse customers who bring back empty cases these customers maybe throw away these empty case and the brewery have to buy also new cases.

The real price for a new bottle is higher (around 0,15 €). So if You ask as a professional iimporter for beers into the USA or another foreign country, a clever brewery has to require more than the official deposit, because the bottles will rest in the foreign country.
