Much as it's difficult for Britons and certain non-Euro-continentals to comprehend, [ Obligatory smiley: ;) ] beer is in fact a foodstuff, and thus falls under the jurisdiction of the regulatory body governing food production. I, for one, don't see allowing exceptions for rat excrement in brewing equipment, but not in, for example, bakery equipment, as a reasonable solution. There have been shut-downs of bakeries, butchers and meat processors reported here in recent years, so it's not just about breweries. One in favour of the closed bakeries could just as easily ask how many people have really been infected by rat-poop-contaminated bread. It's a terrible shame that these breweries can't afford the investment to keep up with what their government requires of them. You've hit upon a topic that has come up in the media: how cheap the "Fränkische Schweiz" is. The head of tourism (?) there recently said that it would be better if taverns charged more than 1,60€ a Seidla and 5,50€ a Schäuferla, specifically so that they could afford to invest in keeping up with modern requirements and even be more profitable. It's caused a bit of a ruckus in the media. People I've discussed this with at the Bierkeller have said --with a straight face-- there should be a tourist price and a local's price. Well, why not? A discount for locals.
