Fake Zoiglbier, Filtered Kellerbier

It was the brewery Scheuerer in Moosbach. http://www.oberpfalznetz.de/zeitung/3426501-127-truebe_aussichten_fuer_klar_etikettiertes_kellerbier,1,0.html They have had a filtered Kellerbier. On their bottles they have written since 15 years, that this beer is fine filtered. In the last year the local office (Lebensmittelüberwachung) has send a bottle to the Bayerischen Landesamt für Gesundheit und Lebensmittelsicherheit (bavarian office for health and food safety). This office says that a Kellerbier has to be non filtered because the customers think that a Kellerbier must be non filtered. The community of the brewers in Bavaria supports this opinion. For the brewery this would mean that they have to destroy some 100.000 labels. You can find filtered Kellerbier also from other breweries. So the "St. Erhard", brewed from the brewery Rittmaier in Hallerndorf for the enterprise St. Erhard in Bamberg and exported to India, China etc. is a filtered Kellerbier. But this is only a problem if the local office would take action. I think they will not do. So it isn't clear which office is responsible (Bamberg-City or Forchheim-Country). The brewery Scheuerer says they offer this beer since 15 years as a beer for their biergarden / Keller (not in the sense of a beer style, but as name which describes the place of the consumption). Before 15 years a definotion of this beer style doesn't exist or You can say: it wasn't a beer style. For some years the award European Beer Star has introduced a new category Kellerbier, defined as non filtered.
