Saw on the TV news show this morning that the Ministers of the Interior of the 16 federal states are meeting to discuss lowering the maximum allowable blood alcohol level (BAC) for bicyclists, on the grounds that the currently allowed level of 1.6 Promille (parts per thousand, 0.16 % by US reckoning) is simply too high. The possible outcome will be a limit of 1.1 Promille (1.1 %). This doesn't mean that the police will set up random check points with breath tests for cyclists, rather, the current procedure will stand: the police generally only stop bicyclists who are riding in such a way as to arouse suspicion, or of course cause accidents. If a cyclist whose riding is obviously impaired is checked by the police and then found to be under the limit, the police can still confiscate the bike or ensure that the cyclist does not continue to ride in that condition, but the cyclist will not be in legal jeopardy. Cycling whilst over the legal limit can result in loss of the cyclist's car driver's licence. For car drivers, the legal limit is 0.3 Promille (0.03 %), if the driver is observed to be driving suspiciously, is involved in an accident or commits a traffic violation. Otherwise, the limit for random check points is 0.5 (0.05 %). |
