The community of the real zoigl (Echte Zoigl) has made a fault. The haven't tried to get a registered geographical brand for the Zoigl, p.e. Oberpfälzer Zoigl. They have tried to get such a brand only for zoigl brewed in community breweries. The Patent Court Munich says, the sense of such a geographical brand is to safe geographical products and not to hinder the competition between different suppliers in a region (p.e. community breweries contra regular breweries). So there is a chance to get a geographical registered brand for Oberpfälzer Zoigl. Then the location of brewing must be part of the region. But then all breweries (old and new, community brewieres or industrial brewers) will have to possibility to brew the Zoigl in the Oberpfalz. An example: The beerstyle "Kölsch" is protected. It isn't allowed to name a beer which has been brewed in other cities as "Kölsch". But everyone can brew Kölsch in the city of Cologne. P.e. If Anheuser-Busch brew in Cologne this beerstyle, they can name it "Kölsch". |
